Welcome to Mountain Dew Safaris. By accessing or using our website and services, you agree to the following terms and conditions. Please read them carefully before making any booking or engaging with our services.
1. General
1.1 These terms and conditions govern the use of Mountain Dew Safaris’ website and services. By using the website or booking a safari, you agree to these terms.
1.2 Mountain Dew Safaris reserves the right to amend these terms at any time without prior notice. Any changes will be posted on our website.
2. Booking and Payment
2.1 A booking is considered confirmed upon receipt of a signed booking form and payment of the required deposit.
2.2 A deposit of 30% is required at the time of booking, with the remaining balance due before the start of the safari.
2.3 Payments can be made via bank transfer, Pesalink, or any other method specified
2.4 Failure to make the final payment by the specified due date may result in cancellation of the booking, and any deposits paid may be forfeited.
3. Cancellations and Refunds
3.1 Cancellation requests must be submitted in writing to Mountain Dew Safaris.
3.2 Cancellation fees are as follows:
- More than 60 days before the start of the safari: 100% refund of the total cost.
- 30-60 days before the start of the safari: 80% refund of the total cost.
- Less than 30 days: No refund.
3.3 No refunds will be issued for no-shows, unused services, or early departures.
3.4 Mountain Dew Safaris reserves the right to cancel a safari due to unforeseen circumstances (e.g., natural disasters, political unrest). In such cases, a full refund or alternative arrangements will be offered.
4. Travel Insurance
4.1 All clients are required to have comprehensive travel insurance covering medical expenses, personal liability, cancellations, and loss of personal belongings.
4.2 Mountain Dew Safaris is not responsible for any costs incurred due to a lack of insurance.
5. Health and Safety
5.1 Clients are responsible for ensuring they are in good health and physically capable of participating in safari activities.
5.2 Mountain Dew Safaris shall not be held liable for any medical emergencies, injuries, or illnesses that occur during the safari unless caused by gross negligence on our part.
5.3 Clients must adhere to all safety guidelines provided by guides and staff during the safari.
6. Liability
6.1 Mountain Dew Safaris shall not be held liable for any loss, damage, injury, or death resulting from any activities related to the safari unless caused by gross negligence on our part.
6.2 We are not responsible for delays, cancellations, or disruptions caused by factors beyond our control, including but not limited to weather conditions, political unrest, or airline schedules.
7. Passport, Visa, and Vaccination Requirements
7.1 Clients are responsible for ensuring their passports, visas, and vaccinations comply with the requirements of Kenya or any other destination included in the safari.
7.2 Mountain Dew Safaris is not responsible for any issues related to incorrect travel documents or health requirements.
8. Wildlife and Environmental Responsibility
8.1 While every effort is made to ensure wildlife sightings, we cannot guarantee sightings as these depend on natural behavior.
8.2 Clients must respect the environment and follow the “leave no trace” principles during their safari.
9. Intellectual Property
9.1 All content on the Mountain Dew Safaris website, including text, images, and videos, is the intellectual property of Mountain Dew Safaris and may not be reproduced without permission.
10. Complaints and Disputes
10.1 Any complaints should be raised immediately with the Mountain Dew Safaris team during the safari. If unresolved, complaints must be submitted in writing within [14 days] after the safari ends.
10.2 Any disputes arising from these terms will be governed by the laws of Kenya.
